Outline:
Esiog's Terms of Service outline the rules for using its website and app. By using the platform or creating an account, users agree to the terms, payment policies, community standards, and privacy policy.
Representation:
- Users must be at least 18, or between 13-18 with a parent or guardian's account.
- Users under 13 are not allowed to use the platform.
- The platform is only available to users not subject to economic sanctions or trade restrictions.
If users do not meet these conditions, they cannot access the platform. Esiog's customer support is available 24/7 for any questions.
Key points:
Buyers: clients who visit our platform for buying our services.
Request a quote: It is a specific offer that a Seller can propose in response to specific requirements of a Buyer.
Sellers: users who are selling their services on ESiog.
Add service: This option allows seller showcase his/her service with or without price, in detail.
Description box: Here the Seller can describe their service and terms, so that the Buyer can easily understand them before placing an Order.
Package Management: This will allow Sellers to offer services in different formats and prices. In Packages, seller can offer privileges according to his own will, our platform allow minimum pricing of 5
Main Terms in Brief:
- Account Registration Required: You can only buy or sell your service on ESiog, when you get your account registered .You have to provide your updated information for account creation.
- Pricing: Sellers set their pricing as per their own will. Services can start at a base price of $5.
- Payments: Buyers should have to pay upfront to create an order. Buyer have to pay 5% more than the price of service.
- Order Fulfillment: Order fulfillment is very important for the seller. As it will affects the seller reputation.
- Payment Methods: Each and every transactions must occur through ESiog; off-platform payments are not applicable.
- Esiog’s marketing Authority: ESiog can use your delivered tasks for its marketing.
About Sellers
Basics:
· Each service, you sell and successfully complete, accredits your account with a revenue equal to 95% of the purchase amount.
· The Seller's rating is calculated based on the reviews posted by Buyers.
· Sellers are responsible for obtaining a general liability insurance policy with coverage amounts that are sufficient to cover all risks associated with the performance of their services.
Add services related:
· Services added on ESiog are generated by User. Added services or users may be permanently blocked by ESiog from the Site due to violations of the Terms. This violation include:
· Illegal or scammed services
· Adult focused services, pornographic services, images, videos.
· Intended copied services.
· Reselling of any product.
· Offer to sell any academic content such as thesis, assignments.
· Rough quality deliveries.
About Buyer:
· Payments on ESiog must be made through the platform, and direct payments outside of ESiog are not allowed.
· ESiog can use published work, including logos, for its marketing and promotion if the user agrees.
· Buyers can request custom offers for specific needs and should use Esiog’s brief features only for legitimate service requests.
· Orders must be paid using legal funds that are not connected to any illegal or fraudulent activities.
For purchasing on ESiog:
· Refer to the Payment Terms for details on payments, fees, and taxes.
· You must only pay sellers through ESiog's platform, and using other payment methods is prohibited.
· If a seller requests an alternative payment method, report it to ESiog's Customer Support immediately.
Orders on ESiog:
Order Creation and Completion:
Orders are created once payment is confirmed.
Meet up:
Some project require in-person meetings between buyers and sellers. ESiog disclaims responsibility for the conduct or safety of parties during such meetings, and encourages buyers to maintain insurance if the service is provided on their premises. Esiog’s terms apply even for services performed outside the platform, and users must avoid unlawful behavior.
Order handling:
· Order Notifications: Sellers are notified of new orders via email and on the site.
· Delivery Time: Sellers must meet the delivery time specified in their service description or custom offers. Late deliveries may lead to order cancellations and harm the seller’s rating.
· Order Completion: Sellers must send the completed files or proof of work when marking the order as delivered.
· Proper Use of "Deliver Work": Misuse of the "Deliver Work" button (e.g., marking incomplete work as delivered) can lead to order cancellations, affect the seller's rating, and result in warnings.
· File Safety: Users are responsible for scanning files for viruses and malware; ESiog is not liable for damages from file transfers.
· .Requests: Buyers can request revisions if the delivered materials do not meet the service description or original order requirements.
Reviews:
· Reviews provided by Buyers are an essential part of ESiog's rating system.
· Reviews will not be removed unless there are clear violations of our Terms.
· To prevent any misuse of our review system, all reviews must come from legitimate and eligible order.
· Purchases arranged, determined to artificially enhance Seller ratings, or to abuse the Site, may result in a permanent suspension of all related accounts.
· Withholding the delivery of services, files, or information required to complete the Service with the intent to gain favorable reviews or additional services is prohibited. Sellers may not solicit the removal of feedback reviews from their Buyers through mutual cancellations.
· Once both Seller and Buyer have completed their reviews, or the applicable review period has passed, all posted reviews are made public.
· Work Samples are added to a Seller's service gallery on their service Page, if the Buyer chooses to publish the Work Sample while providing a public feedback review. Work Samples are the delivered images and videos sent to a Buyer in a delivery message.
User Conduct and protection:
ESiog’s allows users worldwide to create, sell, and purchase services at great value. The platform fosters a friendly, community-oriented, and professional atmosphere, and users are expected to maintain this conduct in all interactions. For reporting violations or account issues, users can contact ESiog's Customer Support.
- Communication Rules: Exchanging personal contact details to communicate outside of ESiog is prohibited. Necessary personal information should only be shared within the Order Page.
- Service and Disputes: ESiog does not guarantee service quality but provides dispute resolution tools in the Order Page.
- Platform Use: ESiog does not protect users who interact outside the platform, and all exchanges of information and files must happen on the site.
- Conduct: Rude, abusive, violent, or discriminatory behavior is not tolerated and may lead to account suspension or removal.
- Off-Platform Deals: Users cannot solicit or engage in contracts or payments outside of ESiog with parties met on the platform.
· Defamation: Users attempting to defame competing sellers by placing orders will have their reviews removed, and further actions may be taken by ESiog's Trust & Safety team.
- No Soliciting for Review Changes: Users must not spam or solicit previous buyers or sellers to remove or modify reviews or cancel orders that don't comply with ESiog's cancellation or feedback policies.
Reporting Violation:
If you encounter content that violates ESiog's Terms or Community Standards, report it through the proper channels. The Trust & Safety team reviews all reports, and decisions may be based on the information provided. Investigation results are not shared to protect privacy. Misusing the reporting system can lead to account restrictions or permanent suspension. Review ESiog's Privacy Policy for more details.
Violations:
Users may receive warnings for violating Terms or misconduct, which will be sent to their email and shown on the site. While warnings don't limit account activity, they can impact progress in the leveling system, exclude users from certain benefits and tools, remove their services from listings, or even result in permanent account suspension.
If action is taken against a user's account or service due to a violation of the Terms, the user will receive an email explaining the reasons and available options for additional review. For more details, users can refer to the Notices and Appeals section.
Non-Permitted Usage:
· Adult Services & Pornography: No exchange of adult content or pornographic materials/services is allowed.
· Inappropriate Behavior & Language: Communication must be friendly, constructive, and professional. Bullying, harassment, and hate speech are prohibited.
· Phishing and Spam: Any attempt to compromise members' security or send malicious content is forbidden. Unrelated contact with members is also prohibited.
· Privacy & Identity: Private and confidential information cannot be shared. Personal information should only be exchanged on the Order Page for service completion.
· Authentic ESiog Profile: Users must not create false identities or impersonate others. Profiles must be accurate and may require verification.
· Intellectual Property Claims: ESiog responds to copyright, trademark, and other intellectual property infringement claims.
· Fraud/Unlawful Use: ESiog cannot be used for illegal purposes, including bypassing sanctions or trade restrictions.
· Crypto-currency: Any content related to crypto-currency is not allowed to exchange. No order will be entertained on ESiog related to forex trading. User cannot give any service related to crypto- currency.
· Singing and Music: Any service showcasing, order or material exchange related to music/ dramatic movies/ signing is not allowed.
· Addictive Drugs and Drinks: No service addition, order and material exchange related to additive drugs and drinks materials/services is allowed.
ESiog’s Policies on Multiple Accounts & Targeted Abuse:
· Multiple Accounts: Users are allowed one active ESiog account. Additional accounts created to bypass guidelines or mislead the community will be disabled. Mass account creation or Terms violations may lead to permanent suspension of all accounts.
· Targeted Abuse: Harassment or abuse, including creating multiple accounts to harass others, is strictly prohibited and not tolerated on ESiog.
· Selling Accounts - You may not buy or sell ESiog accounts.
Dispute and Cancellation Terms:
ESiog encourages Buyers and Sellers to resolve conflicts directly. If issues remain unresolved after using the Resolution Center or if non-permitted site usage is detected, users can reach out to ESiog's Customer Support for help. For details on disputes, cancellations, and refunds, please refer to the Payment Terms.
Notices and Appeals
· Filing Complaints: If ESiog takes action against your account or content, you have the right to challenge the decision by submitting a complaint. This also applies if you disagree with a decision regarding a notice you sent. Complaints must be filed within six months from the date of notification by contacting Customer Support. Be sure to include reasons why you believe the decision should be reversed.
· Fair Review: ESiog will process complaints promptly, fairly, and impartially. If the decision was made in error, it will be corrected.
· Right to Decline Cooperation: ESiog may decline to work with a Dispute Settlement Body if the dispute has already been resolved, is currently in legal proceedings, or if the six-month period for filing a complaint has passed without action.
· Non-Binding Decisions: The decisions made by Dispute Settlement Bodies are not legally binding for either party.
Proprietary Restrictions (ESiog)
· Ownership and Protection: The Site, including its layout, design, content, and materials, is solely owned by ESiog and protected by copyright, trademark, and other intellectual property laws. Trademarks are registered and owned exclusively by ESiog.
· User Restrictions: Users agree not to engage in the following actions regarding the Site or its components:
ü Unauthorized Actions: Copy, transfer, adapt, modify, distribute, transmit, display, or create derivative works without permission.
ü Reverse Engineering: Attempt to reverse assemble, decompile, or derive the source code or underlying structure.
ü Removal of Notices: Remove any copyright or proprietary notices.
ü Use of Unauthorized Software: Employ automation tools, hacks, or modifications to alter the Site.
ü Unauthorized Access: Attempt to gain unauthorized access to or disrupt the Site and its associated systems.
ü Bypass Protections: Circumvent or degrade any technological measures protecting the Site's content.
ü Data Scraping: Use automated tools or manual processes to extract or collect data from the Site.
ü Introduce Malicious Content: Inject viruses, malware, or harmful materials into the systems.
ü Site Impairment: Use the Site in a way that damages, overburdens, or impairs its functionality or user experience.
ü Non-Permitted Access: Access the Site in any manner not explicitly allowed by the Terms.
ü Limited Rights: Users have only a limited right to use the Site in accordance with these Terms of Service. ESiog retains full ownership rights, including all intellectual property rights, and users agree not to act against these ownership interests.
ü Rights Reserved: ESiog reserves all rights related to the Site and its content, including the exclusive right to create derivative works, except for user-generated content (UGC).
Feedback Rights:
Ownership of Feedback: By providing ESiog with any comments, suggestions, or other feedback regarding the Site or its products and services (collectively referred to as “Feedback”), you grant ESiog exclusive, royalty-free, fully paid, perpetual, irrevocable, and worldwide ownership rights to that Feedback.
No Obligation to Implement: ESiog is not obligated to take action on or implement any Feedback received from users.
Confidentiality:
· Confidential Information: Sellers acknowledge that Buyers may need to share confidential information necessary for delivering services, and this information must be protected from unauthorized use or disclosure.
· Sellers' Responsibilities: Sellers agree to treat all information received from Buyers as highly sensitive and classified. Specifically, they agree to:
· Maintain Confidentiality: Keep all information in strict confidence.
· Prohibit Disclosure: Not disclose the information to any third parties.
· Limit Use: Use the information solely for the purpose of delivering the services.
· No Reproduction: Not copy or reproduce any of the information without the Buyer’s explicit permission.
Ownership and Limitations:
· Intellectual Property Rights: When a Buyer purchases a Service on ESiog, they receive all intellectual property rights, including copyright, for the delivered work, unless stated otherwise on the Seller's Service page or in the Custom Offer. The Seller waives any moral rights in the work to the extent permitted by law.
· Assignment of Rights: The Seller expressly assigns copyright and all related rights to the Buyer upon delivery, contingent upon full payment. If payment is canceled for any reason, the delivery may not be used.
· Custom Work Ownership: For custom-created work (e.g., artwork, designs, reports), the Buyer exclusively owns the delivered work and its copyright. The Seller agrees to assign all rights to the Buyer upon delivery.
· Commercial Use License: Some services may offer additional payments for a Commercial Use License. Buyers who purchase for personal use will own the necessary rights for that purpose without needing a license. However, if the work will be used for profit or business purposes, a Commercial Use License must be purchased.
· Voice over Rights: For Voice over Services, upon delivery and payment, the Buyer acquires basic rights for non-commercial use. To use the Voice Over for promotional purposes (excluding paid marketing channels), Buyers must purchase Commercial Rights through service Extras. For radio, television, or internet commercials, Full Broadcast Rights must be purchased through Service Extras.
· User-Generated Content: Users (Buyers and Sellers) agree that any content they voluntarily create or upload to ESiog (including Service texts, photos, videos, usernames, and user images) may be used by ESiog for marketing or operational purposes without compensation, unless explicitly indicated otherwise.
ü Voice-over (buy-out)
If you're buying a voice recording (Voice Over) to use in a project. There are two main types of rights (permissions) you can get with it:
Ø Basic Rights (Non-Commercial Use):
When you buy the voice recording, you're allowed to use it forever, but only for personal projects. You can't use it for business, like in TV or radio ads.
Ø Commercial Rights (Buy-Out):
If you want to use the voice recording for your business, like in a video on your website or social media, you need to buy Commercial Rights. This means you're allowed to use the voice recording for promoting your business, but not in big paid commercials like on TV.
Ø Full Broadcast Rights (Buy-Out):
If you want to use the voice recording for commercials on TV, radio, or online streaming platforms (like YouTube ads), you need to buy Full Broadcast Rights. This gives you permission to use it in big commercial spots.
Both Commercial and Full Broadcast Rights last forever unless you and the seller decide on a specific time limit.
And remember, when you buy these rights, you agree to follow ESiog's rules. The seller or ESiog isn’t responsible for any problems you may have with using the voice recording after you buy it.
ü Commercial Use License:
By purchasing this license, the Buyer is granted a perpetual, exclusive, non-transferable, worldwide license to use the delivered work for approved business purposes.
Ø Ownership Rights: The Seller retains all ownership rights to the delivered work, while the Buyer is licensed to use it for specified commercial purposes.
Ø Permitted Commercial Purposes: The Buyer can use the delivery for business-related activities such as advertising, promotion, creating web content, integrating into products or software, and other commercial applications, excluding any illegal, immoral, or defamatory use.
Ø Terms and Conditions: The license is subject to the platform's terms, and no warranties are provided with respect to the delivery or its suitability for any particular purpose.
Ø Liability Disclaimer: Neither the Seller nor the platform is liable for any claims, damages, or consequences arising from the use of the licensed work.
Disclaimer of Warranties:
Risk: Your use of the platform, its content, and any services or items obtained through it is entirely at your own risk.
As Is" Basis: The platform, its content, and services are provided without any guarantees or warranties, either express or implied, as long as we have exercised reasonable professional diligence.
No Guarantees: Neither the platform nor its associates guarantee the completeness, security, reliability, quality, accuracy, or availability of the site or its services.
Legal Exception: This disclaimer does not affect any warranties that cannot be excluded or limited under applicable law.
Limitation on Liability:
As long as ESiog has acted with reasonable care, neither ESiog, its partners, nor their employees, agents, or directors will be responsible for any type of damages that result from your use or inability to use the site or services. This includes all kinds of damages, such as personal injury, loss of business, data loss, emotional distress, or financial losses, whether caused by negligence, breach of contract, or otherwise. Certain liabilities may still apply if they cannot be legally excluded.
Deactivate and Disable Account:
ESiog can suspend or permanently disable your account if you violate the Terms, deliver low-quality services, or use the site inappropriately or illegally.
If your account is disabled, you won't be able to buy or sell, and related content may be removed. You can appeal these decisions by referring to the Content Moderation section or contacting Customer Support.
You can deactivate your account anytime in your settings, but you're still responsible for any unpaid balances.
Even after deactivating or disabling your account, any agreements between buyers and sellers about Orders will still apply.
Security features:
Users can activate security features to help protect their accounts from unauthorized access.
If you need to verify that you own your account, you will have to provide proof of ownership to Customer Support.
